Terms of service

What the service is

Get Fit Or ___ lets you set a challenge with a deadline, record a photo and a few numbers each day, connect some fitness devices, and, if you want, show your progress to others.

It is a closed, free beta: access is by invitation only, nothing is paid, and the service may change, be interrupted or end. If it ends, members will be told by email in advance and will be able to download their data before it is deleted.

Who can use it

• You must be 18 or older.
• You need an invitation, and the account is personal: one per person, not to be shared.
• You are responsible for keeping access to your email account and, if you use it, your Google account secure: whoever controls them can sign in as you.

Not medical advice

Get Fit Or ___ is a tool for keeping yourself accountable. It is not a medical device and gives no medical, nutritional or training advice. Streaks, charts and numbers from devices can be wrong or incomplete. Before starting a diet or a training programme, and whenever something does not feel right, see a doctor.

Your content

Photos, measurements, journal entries and everything else you add remain yours. You give us only the permission needed to run the service: to store your content, make the copies needed to display it (for example photos resized and stripped of metadata), and show it to you and to the people you choose, through a link or a public page. That permission ends when you delete the content or your account, except for backups, which rotate out as described in the privacy policy.

Nothing becomes visible to others unless you choose to share it, and you can go back to private at any time. We will never use your content for advertising or to train AI models.

Acceptable use

When you use the service, you agree not to:

• post photos or data of anyone under 18;
• post photos of other people without their consent;
• post explicit nudity or sexual content (underwear or swimwear, as in a normal progress photo, is fine);
• post content that is illegal, hateful, or infringes someone else's rights;
• try to access other members' data, get around limits or security, overload the service, or scrape it;
• use the service for commercial purposes or to sell anything.

We may remove content that breaks these rules, and hide a page while we look into a report.

Connected services

Connecting WHOOP, Withings or Oura is optional. Those services belong to their makers and have their own terms, which you accept with them; some need an active membership to provide data. We cannot guarantee they will keep working with Get Fit Or ___, and we may have to switch one off if its maker requires it.

Beta "as is"

The service is provided free of charge, "as is" and "as available", without guarantees that it will be error free, always online or suitable for a particular purpose. Keep your own copy of anything that matters to you: you can export your data at any time.

To the extent permitted by law, Fabio Crestoni is not liable for indirect damages, loss of data or of results arising from the use of a free beta. Nothing in these terms limits liability for intent or gross negligence, or any right you have as a consumer that the law does not allow to be waived.

Ending the relationship

You can stop at any time by deleting your account from the settings; your data is erased as described in the privacy policy.

We may suspend or close an account that seriously or repeatedly breaks these terms. Except in urgent cases (for example illegal content or a security risk), we will tell you first by email and give you the chance to export your data.

Applicable law

These terms are governed by Italian law. If you are a consumer, you keep the protections of the law of the country where you live, and you can take a dispute to the court of the place where you live.

Changes and contact

The version and date are at the top of this page. We will email members before any significant change takes effect; if you do not agree with it, you can delete your account before then.
